One Small Victory for Smokers

The group New York City Citizens Lobbying Against Smoker Harassment (also known as NYC C.L.A.S.H.) finally won a small victory in the battle of smokers’ rights in outdoor public areas, such as state parks and beaches.
The decision by the NY state court was chiefly based on limiting the powers of the Office of Parks, Recreation, and Historic Preservation, who tried to enact the smoking ban in state run parks and beaches. This decision gives back the power to enact such a ban in the hands of the state on New York, and not by a single department.
This decision does not affect any smoking bans currently in place in New York City, as it is specifically affects state run parks.
