Interim injunction in the case of granting asylum to a Turkish officer
- Written by E.Tsiliopoulos
The Administrative Court of Appeals has accepted the request for the temporary suspension of the asylum procedure on grounds of public interest but also for the interests of the Turkish officer himself, as stated in the decision.
In the ruling there is the term "the administration is to abstain from any action aimed at the forced departure of the Turks from the country". This means that the country can not issue his extradition.
After this decision, the Turkish officer was arrested and transferred to the Bureau of Aliens.
The request by the Ministry of Immigration Policy to "freeze" the granting of asylum to the Turkish co-pilot of the helicopter had been debated, without his presence, behind closed doors at the Administrative Appeals Court last Friday.
The public side argued that reasons of public interest require an interim injunction in order to preserve Greek-Turkish relations while the Turkish officer's lawyers argued that the decision of the Secondary Asylum Committee is fully comprehensive and that there is no room for an overturning.
It should be noted, that the request for cancellation by the Ministry of Immigration Policy will be discussed on February 15th.
Former SYRIZA MP and writer Petros Tatsopoulos described national shame as the government's initiative to file a complaint on the granting of asylum to the Turkish officer.
